    We collect and use our users’ personal data only where this is required for the provision of a functional website, as well as our content and services provided within the website. You can find details on these under section 6.

    4.1. Personal data

    Personal data means any information relating to an identified or identifiable natural person. This includes, for example, your name, e-mail address, home address, gender, date of birth, telephone number and age. Non-personal data is information such as the number of users of a website.

    4.2. Processing of personal data

    Where not specifically stated otherwise, your personal data is deleted as soon as the respective purpose for its processing has been fulfilled or no longer applies, unless there are other statutory obligations for processing.

    You can visit our website without giving any personal details. If you use our website solely for information purposes and therefore do not input any personal data, we only process personal data such as your IP-Adress or technically necessary cookies for the purpose to enable you to visit the website as intended.     6. Active use of our website

    Apart from using our website purely for information purposes, you can also actively use our website if, for example, you wish to contact us. Depending on the type of interaction you take, in addition to the above-mentioned processing we also process the following personal data about you:

    6.1 Contact form

    If you decide to direct enquiries to us using our contact form, we will ask you for your surname, your e-mail address and your country. You can also voluntarily provide your first name, your telephone number and your company. You can also enter your individual message to us in the message field.

    It is entirely up to you whether you provide us with this data. However, without this information we will be unable to meet your contact request. Specifying your e-mail address helps us to classify your enquiry and to reply to you. When you use the contact form, your personal data will not be passed on to third parties.

    The data processing previously described for the purpose of establishing contact as well as handle your request is performed with your consent.

    6.2 Training scheduling

    You have the option of registering for seminars via our website. For this purpose, we require your title, full name, position in the company, e-mail address and telephone number. Furthermore, we ask you for the name of your company with complete address, country and language. You can voluntarily provide us with an order number, your date of birth and the department in which you work. You can send us your individual message in the message field.

    It is up to you to decide whether you want to provide us with this data. Without this information we will not be able to fulfil your registration for the seminar, or at least not to the full extent. We need your e-mail address to be able to send you the registration documents. If you would like to be contacted by telephone, you can also provide us with your telephone number. Your personal data will not be passed on to third parties outside the Tadano Group.

    The data processing for the registration and implementation of the seminar is carried out in accordance with your consent.

    6.3 Spare parts order

    You have the possibility to order spare parts via our website. For this purpose, we process the type of your request, your full name and e-mail address, and your company with full address and country. You can enter your telephone number voluntarily. Depending on the type of request, further input such as the crane model or serial number may be necessary for processing your request.

    Without this information, we will not be able to process your order or will not be able to process it fully. Your data will be passed on within the Tadano Group to the responsible company as well as to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods.

    The data processing for the handling of your spare parts order is carried out in accordance with your contract with us, for the provision of our services.

    6.4 Potential supplier questionnaire

    Via this questionnaire we offer you the opportunity to introduce your company to us. For this purpose, only the contact details of the contact person, such as name and e-mail address, are processed as personal data. In addition, the name of the company, company key figures, quality certificates and customer key figures can be provided. The specification of the contact person’s personal data is processed for the purpose of establishing contact. The further information is used to find out about a possible cooperation with your company. Personal data will not be passed on to third parties outside the Tadano Group.

    The legal basis for this data processing are pre-contractual measures or overriding interests of keeping a record of potential suppliers.

    6.5 Advertising for our own similar goods or services

    You may receive information and advertising from us if we have received your e-mail address in connection with the purchase of a product or service provided by us. In this case, we reserve the right to inform you about our own, similar goods or services if applicable. You have the right to object to this promotional contact at any time and without providing reasons. To do so, you can either e-mail your objection to dpo-tadano@kinast.eu for the jurisdictions specified under section 3., or use the unsubscribe link at the end of every e-mail. We assure you that your data will not be passed on to third parties. We only reserve the right to pass on the e-mail address internally to companies of the TADANO Group for the same purpose.

    The legal basis for the processing of your e-mail address is our legitimate interest in providing updates regarding our own similar goods or services for company growth.

    6.6 Subscription to our newsletter

    We offer you the opportunity to keep up to date with different types of news and information about our company, including direct marketing of our new products and services. Your subscription to our newsletter is entirely voluntary and requires the input of your last name and e-mail-address, business role and the country you are located in. Optionally you may also include your first name and company name. You can withdraw your consent at any given point in time for the future by clicking the unsubscribe link in the newsletter communication. Your personal data will be deleted upon unsubscribing.

    The data processing for the registration and implementation of the seminar is carried out in accordance with your consent.

    6.7 Application process via our website

    You have the option to apply for a job via our website. In this case, data related to your application will be processed. This may include general information about you (such as your name, address and contact details), information about your professional qualifications and schooling, or information about professional development, or other information that you provide to us in connection with your application.

    You can upload your application documents directly using the online application tool. The provision of this data is voluntary, but we may not be able to consider your application without it.

    As part of the application process, we assure you that we will only process the personal data you provide for the purpose of carrying out the application process. Your personal data will be deleted six months after any rejection.

    Within our company, your personal data will only be disclosed to individuals and departments (e.g. the specialist department, the works council, HR employees) who require it to fulfil our (legal) obligations.

    6.8 Application by e-mail or post

    While we would prefer online applications, if you decide to send us your application documents by e-mail or by post, we will process your personal data exclusively for the purpose of carrying out the application process. We will not pass them on to third parties.

    Your data will be stored in our electronic applicant management system and in our cloud-based e-mail system for administrative purposes. Your documents will be deleted no later than six months after the selection process has been completed.

    6.9 Application via a recruitment service

    There is also the possibility that your application documents will be sent to us via head-hunters or temporary employment agencies in order for us to include you in our application pool. Beyond that, your data will only be stored in our electronic applicant management system and in our cloud-based e-mail system for administrative purposes and will be deleted no later than six months after the selection process has been completed. It will not be passed on to third parties.

    6.10 Job alerts

    We offer you the opportunity to set up a job alert on our website. If you wish to receive this alert, we require your e-mail address. It is entirely up to you whether you provide us with your e-mail address. However, without this information, we will not be able to send you our job alert. When you register for the job alert, your e-mail address will only be used to inform you about job offers. You will receive the job alert until you unsubscribe. You can unsubscribe via a link within the job alert e-mail. After unsubscribing, we will delete your personal data.

    The legal basis for the processing of data after registration for the job alert by the user is the consent of the user.

    6.11 Application, apprenticeship communication and electronic report book review for under aged persons (applicable to Germany only)

    As part of our apprenticeship program in Germany, it is possible that we process personal data of your parents or legal guardian as part of the application and apprenticeship process if you are under the age of 18. In particular, this may include name and e-mail address for communication purposes, signatures for contract signing, as well as confirmation of review of the electronic report book. We will delete this personal data once you turn 18 and your parents or legal guardian no longer have to be involved in the process.

    The legal basis for the processing of the personal data of your parents or legal guardian for the application and apprenticeship process, communication and electronic report book review is a legal obligation in conjunction with local legal requirements.

    The legal basis for the assertion of any legal claims and defence in the event of legal disputes is the fulfilment of a legal obligation as well as our legitimate interest in the assertion of, exercise or defence against legal claims.

    6.12 “Hey Tadano” AI-Chatbot

    We offer you the opportunity to register your log-in information in order to use our “Hey Tadano” AI-Chatbot in order to address a great variety of questions regarding our products and services. As part of this registration, it is necessary to input your name and e-mail-address, you may also voluntarily provide the name of the company you work for. This personal data is only used for log-in purposes, and no personal data is required to be provided to the AI-Chatbot.

    Please note that we ask you to refrain from inputting any personal data into your text sent into the AI system of “Hey Tadano”, as it is not intended for the system to process personal data other than for login purposes. The AI system is not intended to be trained on personal data of our employees or customers.

    The legal basis for the processing of data after registration for “Hey Tadano” by the user is the consent of the user.

    The legal basis for the assertion of any legal claims and defence in the event of legal disputes is the fulfilment of a legal obligation as well as our legitimate interest in the assertion of, exercise or defence against legal claims.

    7. Disclosure of your personal data within the Tadano Group and with other third parties

    We reserve the right to share your data internally with companies of the Tadano Group if it is necessary for various operational tasks that your data be made available to these Group companies, e.g. in the case of an order for spare parts or registration for a training course. In this case, we have signed an intercompany data protection agreement within the Tadano Group, which ensures that your data is protected with the same level of data protection at all Group companies.     We use service providers to provide services and to process your personal data relating to our services. The service providers process the data exclusively within the scope of our instructions and have been obligated to comply with the applicable data protection regulations. All service providers have been carefully selected, have signed the relevant data protection agreements and are only given access to your personal data to the extent and for the period of time required to provide the services or to the extent that you have consented to the data processing and use.

    Your personal data will be disclosed or otherwise transferred to third parties if

    • we require the use of a service provider for the provision of our goods and/or services;
    • we are legally obliged to do so on the basis of an official or judicial order;
    • we are entitled to do so, e.g. because this is required in order to prosecute a criminal offence or to exercise and enforce our rights; or
    • you have given your prior consent.

    8. Data processing in a third country

    In general, we try and select service providers where the transfer to a third country takes place on the basis of an adequacy decision of the European Commission. If there is no adequacy decision of the European Commission for the respective third country, the transfer to a third country will take place on the basis of appropriate safeguards based on the Standard Contractual Clauses of the European Commission. Third countries are all countries outside the European Economic Area. The European Economic Area includes all countries of the European Union and the countries of the so-called European Free Trade Association. These are Norway, Iceland and Liechtenstein.

    As part of our internal sharing of personal data with companies of the Tadano Group, data transfers to third countries may also take place under the afore-mentioned requirements.

    9. Security measures to protect saved data

    We pledge to protect your privacy and to treat your personal data confidentially. To prevent loss or misuse of the data we save, we take comprehensive technical and organisational safety precautions, which are regularly reviewed and updated in keeping with the latest technological advances. However, you should be aware that the Internet is structured in such a way that data protection rules or the above security measures may not be observed by other persons or organisations outside our sphere of influence. In particular, it is possible for unencrypted data to be read by third parties – if disclosed in an e-mail, for example. We have no technical influence over this. It is the responsibility of the user to protect from misuse any data made available either by way of encryption or by other methods.

    10. Rights of data subjects

    10.1 Right of access

    You have the right to demand information from us at any time about what data we have stored about you, its origin, and the recipients or categories of recipients to whom this data is passed on and the purpose of storage

    10.2 Right of withdrawal

    If you have granted consent to the use of data, you can withdraw this at any time with future effect, without providing reasons. To do so, you can send an e-mail to the specific contact according to section 3.

    10.3 Right to rectification

    If your personal data stored by us is incomplete or incorrect, you can demand its immediate completion or correction.

    10.4 Right to erasure and blocking

    You have the right to block and delete your personal data stored by us. Deletion of your personal data usually takes place within two working days of exercising this right as a data subject. Should deletion conflict with legal, contractual, fiscal or commercial retention periods or other legal causes, your data may be blocked instead. Following deletion of your data, the provision of information is no longer possible.

    10.5 Right to restriction of the processing

    You have a right to demand restriction of the processing of your personal data if you have contested the accuracy of your personal data, the processing is unlawful and you oppose to the erasure of your personal data, if we do not your personal data for the mentioned purposes, if you have objected to the processing and are pending the verification of our legitimate interest.

    10.6 Right to data portability

    Should you demand the return of personal data provided to us, we will issue or transmit the data to you or to another responsible person if you wish, in a structured, common and machine-readable format. However, the latter option is only performed if technically possible.

    10.7 Right to object

    You have the right at any time for reasons based on your special situation to object to the processing of your personal data if data processing is carried out based on our legitimate interest. To object to the processing of your personal data, you can send an e-mail to the specific contact according to section 3.

    10.8 Contact for assertion of the rights of data subjects

    When contacting us by e-mail according to section 3., the data you provide (your e-mail address and possibly your name and telephone number) is stored by us in order to answer your questions or to address your concern. We delete the data arising in this context once storage is no longer required or restrict processing if statutory retention obligations apply.

    10.9 Right to lodge a complaint with supervisory authorities

    You have the right to lodge a complaint with the competent supervisory authority against the processing of your personal data if you consider your rights to be violated.

    11. Automated decision-making/profiling

    We do not use any automated decision-making or profiling (automated analysis of your personal circumstances).

    12. Additional Jurisdictions

    12.1 Australia

    Under the Australian Privacy Act, you may lodge a complaint about a breach of the Australian Privacy Principles.

    If you wish to make a complaint about how Tadano deals with your personal information, you can contact us according to section 3.

    To assist Tadano to gather relevant information about your complaint, please provide as much information as possible in describing how you think your privacy has been interfered with, including:

    • What happened
    • When it happened (including dates)
    • What personal information of yours was affected
    • Who did it (include individual names if known)
    • How and when you found out about it
    • Your contact details
    • Any other relevant information, including what, if any, outcome you might be expecting from the complaint process.

    We will provide a written response to your complaint. If a breach of the APPs has been identified as a result of your complaint, we will advise you of the findings. We aim to provide you with a response within 30 days.

    12.2 Brazil

    Under the Lei Geral de Proteção de Dados (LGPD), we are obligated to specify and highlight when the processing of your personal data is necessary for the provision of a product or a service, or the exercise of a right.

    Please note that the processing of the specified personal data under 6.1, 6.2. and 6.3. is necessary for the provision of the related product and/or service. Without your personal data, it is impossible for us to provide you with these products or services.

    In addition, in order for us to process your data subject right mentioned under 11., it is necessary for us to process your full name, contact details, proof of your identity, as well as the personal data relating to the processing of personal data applicable to your right. We require this personal data in order to handle your request and communicate with you, as well as ensure we can comply with the exercise of your rights.

    12.3 China

    Under the Personal Information Protection Law (PIPL), we are obligated to inform you about the data transfer specifics in case of the transfer of your personal data outside of China.

    Should we provide any product or service to you, the personal data mentioned under the respective processing in section 6 of this Privacy Policy will be transferred to the Tadano Group entity responsible for the provision of the product or service. The entity may differ depending on the nature of the product and service, as we cannot ensure all products and service to be in stock at one particular Tadano Group entity.

    12.7 Unites States of America

    Several state data protection laws in the Usa require us to disclose additional information on our processing of personal data, in particular regarding any potential sale of this personal data.

    Please note that we do not intend to sell any personal data contained in this Privacy Policy. When we share information for purposes of targeted advertising or advertising networks, such sharing may be considered a “sale” of information under some state laws. You may request to opt out of such sharing of information according to section 9. by individualizing your cookie settings.

    As we do not target an audience of children under the age of 18, we do not have knowledge that we share or sell any personal data respectively.

    Residents of the United States of America may have the right to: (1) know what personal information we collect, use, disclose, and sell; (2) request that we delete your personal information; (3) access and obtain a copy of your personal information that we collect; (4) request correction of inaccurate personal information; (5) opt out of targeted advertising; or (6) limit the use and disclosure of certain sensitive information, (7) request a list of categories of third parties to which we have disclosed your personal information.     You may designate an authorized agent to exercise the foregoing rights on your behalf. An agent may be an individual or a business entity registered with your Secretary of State. To designate an authorized agent, you must provide the agent with written permission to submit the request. We may still require you to verify your identity directly (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization. We keep this personal information for the period of the request, and for the duration of the period of potential legal claims following the finalization of your request.

    We may make changes to this Privacy Policy from time to time.
